1. Using our Services

a. Representations and Age Restriction.

By using our Services, you represent and warrant that:

• (a) the information and details you submit are true, accurate, and reflect reality;
• (b) your use of the Services does not violate any applicable laws or regulations.

You affirm that you are at least 13 years of age and a “natural person” in your country of residence, fully competent to enter into the terms, conditions, obligations, representations, and responsibilities set forth in these Terms, and to comply with them.

b. Your Nurba! Account

To access our Services, including all in-game features, you must create a Nurba! account (“User Account”). To create a User Account, you must:

• Be at least 13 years old.
• Be a “natural person” in your country of residence.
• Provide truthful and accurate information about yourself.

You may hold only one User Account. Sharing or using another person’s User Account is strictly prohibited.

You agree that you are fully responsible for all activities occurring under your User Account, including transactions or communications made through it. You must maintain the confidentiality of your password and restrict access to your devices to prevent unauthorized use of our Services. Nurba! is not obligated to investigate the authorization or source of any access or use of the Services.

You will be solely responsible for all access to and use of the Services by anyone using your password and identification, whether or not such access or use is authorized by you. This includes all communications and transmissions, as well as all obligations (including financial obligations) incurred through such access or use.

You agree to immediately notify Nurba! of any unauthorized use of your password or User Account, or any security breaches you become aware of, by contacting the Nurba! Support Form. Delayed notification may result in loss of account access and/or liability for any unauthorized activities.

Access to the website is limited for non-user accounts. As a User Account holder, you are expected to follow community guidelines and terms of service; failure to comply may result in moderation actions or penalties in both the website and in-game. This includes warnings, temporary suspensions, or permanent bans from the Services.

We reserve the right to take any actions we deem necessary or reasonable to maintain the security of our Services and your User Account, including but not limited to:

• Terminating/Prohibiting access to your User Account.
• Changing your password.

2. Prohibited Use of Our Services

While using the Services, you must comply with all applicable statutes, orders, regulations, rules, and other laws. You are prohibited from, or assisting others to:

• Use the Services to send or post harassing, abusive, or threatening messages;
• Solicit passwords or personal information for commercial or unlawful purposes, including hidden pages, links, or images;
• Provide instructional information about illegal activities, or threaten our relationships with partners, customers, or suppliers;
• Attempt to conceal or misrepresent the identity of the sender or person submitting information;
• Invade someone’s privacy;
• Disrupt the normal flow of the Services, including dialogue on the Services, or act in a manner that negatively affects other participants;
• Transmit unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, hateful, or otherwise objectionable materials;
• Use the Services or any Content or User Content to stalk, harass, abuse, intimidate, defame, threaten, defraud, or mistreat others;
• Post misleading, false, or inappropriate User Content;
• Post content that exploits, harms, or endangers children;
• Post discriminatory User Content;
• Damage the image or rights of Nurba!, other users, or third parties;
• Send spam or unsolicited advertising;
• Transmit executable programming, including viruses or any form of disabling mechanisms;
• Use any automated program to monitor or extract information from the Services;
• Attempt to circumvent security features of the Services;
• Promote any activity that violates applicable local, provincial/state, national, or international laws while using or accessing the Services.

3. Termination

These Terms are effective from the moment you first access or use the Services and remain in effect until they are terminated by us or until you stop using the Services.

We reserve the right to suspend, restrict, or terminate your access to all or part of the Services or any of its features at any time, with or without notice and with or without reason, including if we believe you have violated or acted contrary to these Terms. Upon termination:

• You must delete all Materials obtained from the Services and any copies thereof;
• You must immediately stop using and accessing the Services;
• We may delete or disable access to your User Content at any time;
• You are prohibited from creating a new account, as outlined in rule 1, and any attempts to do so will be considered a violation of these Terms;
• The termination applies to both the game and the website, as any breach affects both in-game and site terms;
• Appeals can only be made through the designated appeal process.

If your access to the Services is terminated as described in these Terms, you agree not to attempt to use the Services under any name, real or assumed. If you violate this restriction post-termination, you agree to indemnify and hold us harmless from any resulting liability. Continued use of the Services after termination will be considered a violation of this section, which remains effective beyond termination.

Sections of these Terms related to intellectual property rights, prohibited use, user-submitted content, disclaimers, limitations of liability, indemnification, and Disputes, as well as any other provisions intended to survive termination, shall remain in effect.

4. User Responsibilities

As a user of the Services, you agree to:

• Comply with the community guidelines and terms of service at all times;
• Promptly report any user violations or breaches of the Terms to Nurba!;
• Use the Services responsibly, showing respect to other users and their rights;
• Participate fairly in all games and activities, refraining from cheating or exploiting any vulnerabilities;
• Understand that you are solely responsible for your interactions with other users, and that Nurba! is not liable for any disputes arising from these interactions.

5. Intellectual Property Rights

All content, features, and functionality provided on the Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the sole property of Nurba! or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited license to access and use the Services solely for personal, non-commercial purposes.

You agree not to:

• Modify, reproduce, distribute, or create derivative works from any materials on the Services;
• Employ data mining, robots, or other data extraction methods;
• Remove any copyright or proprietary notices from materials obtained through the Services;
• Use the Services for commercial purposes without our explicit written permission.

Nurba! does not guarantee uninterrupted, secure, or error-free Services. You acknowledge that using the Services is at your own risk.

8. Limitation of Liability

Nurba! and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Services. This includes, but is not limited to, damages for lost profits, goodwill, use, data, or other intangible losses, even if Nurba! has been advised of the possibility of such damages.

These Terms are governed by and interpreted in accordance with the laws of the jurisdiction in which Nurba! operates, without regard to conflict of law provisions. Any legal action or proceeding related to these Terms must be brought exclusively in the courts of that jurisdiction.

10. Modifications to Terms

Nurba! reserves the right to modify or update these Terms at its discretion. If changes are significant, we will provide at least 30 days' notice before the new terms take effect. You must agree to the updated terms to continue using the Services. Failure to respond within 2 weeks of notification may result in further account actions.

By continuing to access or use our Services after the revisions become effective, you agree to the new Terms. If you do not accept the changes, you are no longer authorized to use the Services.
